- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- PRIMERO. Declárase EXEQUIBLE el Decreto Legislativo No. 700 del 24 de abril de 1992, "Por el cual se adoptan medidas en materia de contratación, endeudamiento, presupuesto y reestructuración de las entidades del sector eléctrico y se adoptan otras disposiciones con el fin de conjurar la crisis en el servicio público de energía eléctrica e impedir la extensión de sus efectos", salvo los apartes que a continuación se indican.
- SEGUNDO. En cuanto se refiere al inciso 2o. del artículo 10 ("Así mismo, el Gobierno Nacional podrá adoptar las reformas estatutarias y reestructuraciones administrativas de las entidades del orden nacional del sector eléctrico que sean necesarias para los fines del presente decreto") y a las expresiones "Con base en lo anterior, el Gobierno Nacional adoptará las reformas estatutarias a que haya lugar", pertenecientes al artículo 13, son EXEQUIBLES interpretadas únicamente en el sentido de que las atribuciones allí conferidas al Ejecutivo se ejercerán "con sujeción a los principios y reglas generales que defina la ley", tal como lo establece el numeral 16 del artículo 189 de la Constitución Política.
- En consecuencia, los referidos apartes, bajo cualquier otra interpretación, son INEXEQUIBLES.
