- Estarse a lo resuelto en la sentencia C-309 de 1996, en la que se declararon inexequibles las expresiones "o cuando la viuda contraiga nuevas nupcias o haga vida marital" del articulo 2 de la Ley 33 de 1973; "o cuando contraiga nuevas nupcias o haga vida marital" del articulo 2 de la Ley 12 de 1975; y "por pasar a nuevas nupcias o por iniciar nueva vida marital" del articulo 2 de la Ley 126 de 1985.
