Revisión constitucional del Decreto 11 de enero 21 de 2010 “Por el cual se crea el Sistema Técnico Científico en Salud, se regula la autonomía profesional y de definen aspectos del aseguramiento del Plan Obligatorio de Salud y se dictan otras disposiciones”.
La Corte declara la inexequibilidad por consecuencia del Decreto estudiado, ya que mediante la sentencia C-252 de 2010 esta corporación declaró inexequible el Decreto 4975 de 2009 por el cual el Presidente de la República declaró el estado de emergencia social, por un período de treinta días, por lo tanto al haber desaparecido del ordenamiento jurídico el fundamento normativo que sirvió de sustento a la expedición del presente Decreto, éste necesariamente deviene inconstitucional.
