- En merito de lo expuesto, la Corte Constitucional
- R E S U E L V E:
- PRIMERO. DECLARAR INEXEQUIBLE el aparte del articulo 322 numeral 3o del Decreto 663 de 1993 que dice "En general, el fondo gozara de reserva sobre sus papeles, libros y correspondencia".
- SEGUNDO. DECLARAR EXEQUIBLE el aparte del articulo 322 numeral 3o del Decreto 663 de 1993 que dice "Reserva de informacion. El Fondo de Garantias de Instituciones Financieras estara obligado a guardar reserva sobre las informaciones que exija a las instituciones financieras inscritas, salvo en los casos previstos en la Constitucion y en la ley", bajo el entendido de que dicha reserva versa unicamente sobre informaciones que por su naturaleza material conciernen unicamente a la institucion financiera en particular y, ademas, carecen de relevancia financiera externa y se encuentran por fuera de los mandatos legales de divulgacion publica.
