Solicitud de Nulidad de la sentencia T-954/11.
El memorialista aduce que la sentencia de la referencia está indebidamente fundamentada por argumentación deficiente y que desconoció la ratio decidendi establecida en algunas sentencias de la Corporación, las cuales resultaban esenciales para tomar una decisión.
Frente a esta última argumentación indica además que, no haber tenido en cuenta los fallos implicó un cambio de jurisprudencia.
La Sala Plena encuentra que las críticas realizadas a la sentencia T-954/11no son de recibo, toda vez que la argumentación esgrimida por el solicitante y los asuntos por él citados no constituyen una elusión arbitraria del análisis de relevancia constitucional, un cambio de jurisprudencia o una suerte de insuficiente motivación.
Se decide NEGAR la solicitud de nulidad impetrada.
