Se declaró la nulidad de todas las actuaciones surtidas en el proceso de la referencia incluido el auto admisorio de la demanda porque se le dio aplicación al Art. 1º del Decreto 1382 de 2000, por lo anterior, la Sala Plena de esta Corporación ha venido señalando que el Art. 1º del mencionado decreto es manifiestamente contrario a la Carta Política y por lo tanto debe ser inaplicado, acudiendo para ello a la figura de la excepción de inconstitucionalidad.
En consecuencia, ordenó remitir el expediente al Consejo de Estado para que realice el trámite que corresponda conforme a la Constitución y la Ley.

- Primero. DECLARAR la nulidad de todas las actuaciones surtidas en el proceso de la referencia, incluido el auto admisorio de la demanda proferido el día 29 de noviembre de 2000. En consecuencia, por Secretaría General de la Corte remítase el expediente al Consejo de Estado, para que de manera inmediata se le imprima a la petición de tutela el trámite que corresponda conforme a la Constitución y la Ley.
- Segundo. Por Secretaría General de la Corte, COMUNÍQUESE esta decisión a la accionante, señora Luz Estella Giraldo Parra.
