Se decretó la nulidad de todo lo actuado en la presente acción de tutela, a partir, del auto proferido por el Consejo de Estado, lo anterior, con el único fin de evitar la omisión de la instancia de impugnación de la sentencia de primer grado en el presente asunto.
En consideración, la Corte devolvió el expediente a la mencionada Corporación para que ésta decida sobre la impugnación presentada contra la sentencia del Tribunal de la referencia.

- PRIMERO. DECRETAR la nulidad de todo lo actuado en la presente accion de tutela, a partir, del auto del h. Consejo de Estado, Sala de lo Contencioso Administrativo, Seccion Segunda, de fecha veintisiete (27) de noviembre de mil novecientos noventa y cinco (1995).
- SEGUNDO. ORDENAR que por la Secretaria General de esta Corporacion, se devuelva el expediente de la referencia al h. Consejo de Estado, Sala de lo Contencioso Administrativo, Seccion Segunda, para que esta decida sobre la impugnacion presentada contra la sentencia del Tribunal Administrativo de Cundinamarca, Seccion Primera, de fecha octubre veintitres (23) de mil novecientos noventa y cinco (1995).
- TERCERO. Para efectos de la revision eventual de ley, el h. Consejo de Estado, Sala de lo Contencioso Administrativo, Seccion Segunda, una vez resuelta la impugnacion, devolvera el expediente a la Corte Constitucional.
