- Primero. REVOCAR por las razones expuestas en esta providencia, el fallo proferido por la Sala Penal de la Corte Suprema de Justicia el día uno (1) de febrero de dos mil (2000).
- Segundo. CONCEDER la tutela por los derechos a la igualdad, al trabajo y a la estabilidad laboral reforzada de la ciudadana FRANCENED DELGADO FRANCO, y por lo tanto, ORDENAR al Representante Legal de Inversiones Quipla & Cia Ltda., que reintegre a la demandante en el término de cuarenta y ocho (48) horas al cargo que venía desempeñando al momento del despido, sin perjuicio de las demás pretensiones laborales a que pueda tener derecho, las cuales serán definidas por la jurisdicción laboral.
- Tercero. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
