- Primero. REVOCAR el fallo proferido por el Juzgado
- Primero. Civil del Circuito de Valledupar. En consecuencia, CONCEDER la acción de tutela en favor de la actora para proteger su derecho a la educación, el cual se considera amenazado con la conducta de la demandada.
- Segundo. ORDENAR al demandado, Instituto de Seguros Sociales, Seccional Valledupar, que en el término de cuarenta y ocho (48) horas siguientes a la notificación de este fallo, se asegure de reanudar el pago de las mesadas pensionales correspondientes a la demandante, presentando copia de la presente providencia ante la autoridades centrales del I.S.S. encargadas de incluir a la accionante en la nómina de pensionados.
- Tercero. PREVENIR a la demandada a fin de que adopte las medidas tendientes a evitar que vuelva a incurrir en las acciones y omisiones como las que han dado origen a la presente acción, so pena de hacerse acreedor a las sanciones de ley.
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
