Primero. REVOCAR PARCIALMENTE la sentencia proferida por el Juzgado 86 Penal Municipal de Bogotá, de fecha 19 de marzo de 2002, mediante la cual se denegó la acción de tutela instaurada por el señor PAULO PAYARES RUGE contra la Fiscalía 157 Seccional de Yumbo (Valle) y el Departamento Administrativo de Seguridad "DAS", y en su lugar CONCEDER la tutela por violación del derecho fundamental al debido proceso del accionante por parte de la Fiscalía Seccional 157 de Yumbo - Valle-.
Segundo. ORDENAR al Fiscal Seccional 157 de Yumbo-Valle- que en el término de diez (10) días contados a partir de la notificación de la presente providencia, si aún no lo ha hecho, proceda a resolver la situación jurídica del señor PAULO PAYARES RUGE.
Tercero. COMPULSAR copia de esta providencia al Consejo Seccional de la Judicatura del Valle del Cauca, para lo de su competencia.
Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
