- Primero. Revocar las sentencias proferidas por el Tribunal Superior del Distrito Judicial de Santafe de Bogota -Sala Penal-, y la Corte Suprema de Justicia -Sala de Casacion Penal- y, en su lugar, declarar fundada la peticion del actor unicamente para efectos de indemnizacion y de costas, pues se violo el derecho al debido proceso del actor, de acuerdo con las consideraciones que anteceden.
- Segundo. Comunicar esta providencia al Tribunal Superior del Distrito Judicial de Santafe de Bogota, para los efectos previstos en el articulo 36 del Decreto 2591 de 1991.
