El actor padece de deficiencias renales agudas, solicitó a la entidad accionada se le ordenara unos exámenes de laboratorio de “nefructomía Izaida”, por insuficiencia renal pero la entidad se negó a autorizar dichos exámenes.
La Sala constata que se encuentra frente a un hecho superado, ya que la ARS ha cubierto el tratamiento de manera integral al encontrarse incluido dentro del POS.

- Primero. LEVANTAR la suspension de los terminos en el proceso de la referencia, decretada en auto de febrero 12 de 2008.
- Segundo. DECLARAR la carencia de objeto y CONFIRMAR, dentro de las consideraciones expuestas en esta providencia, la sentencia proferida el 24 de julio de 2007 por el Juzgado
- Cuarto. Civil Municipal de Ibague, que nego el amparo solicitado por Noel Espinosa Alvarez contra la Secretaria de Salud Municipal de Ibague.
- Tercero. PREVENIR a la ARS Solsalud, para que en lo sucesivo se abstenga de incurrir en la omision que dio origen a la presente accion de tutela.
- Cuarto. Por Secretaria General, LIBRESE la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
