- Primero. REVOCAR la sentencia dictada por la Sala Penal del Tribunal Superior del Distrito Judicial de Bogotá, en la cual se denegó la tutela impetrada.
- Segundo. CONCEDER a CESAR EDUARDO ALFONSO PRIETO, identificado con la Cédula de Ciudadanía No. 79.654.964, expedida en Bogotá, la tutela de sus derechos fundamentales al buen nombre y a la honra, la cual se hará efectiva, como se indica en los ordinales siguientes, en el término de cuarenta y ocho (48) horas.
- Tercero. ORDENAR, en los términos del numeral 7 de esta providencia, al Juzgado Dieciocho Penal del Circuito de esta ciudad que a continuación de la sentencia condenatoria proferida contra quien usó el nombre e identificación de CESAR EDUARDO ALFONSO PRIETO, se haga constar que el condenado es persona distinta a CESAR EDUARDO ALFONSO PRIETO, portador de la cédula de ciudadanía 79.654.964 de Bogotá, peticionario de la tutela que se concede.
- Cuarto. ORDENAR que se oficie a la División de Reseña e Identificación del Departamento Administrativo de Seguridad DAS, con el fin de que elaboren o abran sendos folios o registros independientes, cada uno con la correspondiente cartilla decadactilar, al señor CESAR EDUARDO ALFONSO PRIETO, quien se identifica con la Cédula No. 79.654.964 de Bogotá, y a N.N. o "Cesar Eduardo Alfonso Prieto", indocumentado, incluyendo en relación con este último la condena proferida por el Juzgado Dieciocho Penal del Circuito de que da cuenta la parte motiva de esta sentencia. Al oficio respectivo se anexará copia del presente fallo.
- Quinto. LIBRENSE por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
