- Primero. REVOCAR la decisión adoptada por la Sala Penal del Tribunal Superior de Santafé de Bogotá, y confirmar parcialmente el fallo proferido por el Juez
- Noveno. Penal del Circuito de la misma ciudad, a través del cual se le protegieron los derechos a la vida y a la integridad física a Luis Fernando Marín.
- Segundo. ORDENAR al Director del INPEC que la reclusión del señor Marín se cumpla en un sitio que reúna las condiciones de seguridad contempladas en el artículo 402 del Código de Procedimiento Penal.
- Tercero. LIBRAR por Secretaría las comunicaciones a las que se refiere el artículo 36 del Decreto 2591 de 1991.
