- Primero. ORDENAR el levantamiento de los términos en el proceso de la referencia, los cuales se hallaban suspendidos.
- Segundo. REVOCAR las decisiones adoptadas en el proceso de la referencia por el Juzgado
- Primero. Civil del Circuito de Riohacha y el Tribunal Superior del Distrito Judicial de Riohacha -Sala Laboral- y en su lugar CONCEDER la protección de los derechos a la salud y la seguridad social, en conexidad con la vida digna de la señora Naydet Carolina Moscote Valera.
- Tercero. ORDENAR al Seguro Social E.P.S. que dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, proceda a autorizar a la accionante la práctica del procedimiento denominada queratoplastia lamelar con láser (pachy link) ordenada por el médico tratante, para que sea practicada por profesional idóneo en ese procedimiento.
- Cuarto. AUTORIZAR al Seguro Social E.P.S. para que recobre ante el Fosyga la diferencia que surja entre los costos del procedimiento incluido en el POS y el ordenado por el médico tratante.
- Quinto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
