- Primero. REVOCAR la sentencia del 20 de enero de 1999, proferida por la Sala Laboral de la Corte Suprema de Justicia.
- Segundo. CONFIRMAR la sentencia del 26 de noviembre de 1998, de la Sala Laboral del Tribunal Superior del Distrito Judicial de Cucuta, adicionandola en el sentido que, en el presente caso, el actor cuenta con otro medio de defensa judicial ante la jurisdiccion laboral.
- Tercero. LIBRENSE por la Secretaria General de esta Corporacion, las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
