Primero. CONFIRMAR, pero por las razones señaladas en este proveído, la sentencia de fecha tres de diciembre de 1997 emitida por la Sala Penal del Tribunal superior de Distrito Judicial de Ibagué.
Segundo. PREVENIR a la Alcaldía y Tesorería Municipales de Ambalema (Tolima) para que en el futuro se abstengan de incurrir en conductas atentatorias de la libertad de asociación, y efectúen el pago de los aportes sindicales dentro de la oportunidad correspondiente.
Tercero. Líbrese por la Secretaría General de esta Corporación, la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
