- Primero. REVOCAR la decisión de segunda instancia en la tutela de la referencia y en su lugar confirmar parcialmente la de primera instancia proferida por la Sala Penal del Tribunal de Santa Marta el 11 de abril de 1996. En consecuencia, se CONCEDE la tutela porque hubo violación al debido proceso en la tramitación de la querella policiva por parte del Secretario de Gobierno de Ciénaga, en el caso de José Hasbún contra Ramiro Dávila, quedando sin efecto todo lo actuado a partir del auto de 12 de enero de 1996 inclusive y se ordenar que se pase el expediente al Alcalde Municipal para que directamente aboque el conocimiento.
- Segundo. Para los efectos del artículo 36 del decreto 2591 de 1991, el Tribunal de origen hará las notificaciones y tomará las medidas adecuadas.
