- Primero. REVÓCASE la sentencia proferida el día 20 de abril de 2004, por el Juzgado Trece Penal Municipal de Cali, que denegó la acción de tutela instaurada por el señor José Enrique Copete en calidad de agente oficioso de la señora Margarita Pérez Durango, en contra de la Secretaría de Salud Municipal de Cali.
- Segundo. En consecuencia, ORDÉNASE la Secretaría de Salud Municipal de Cali, a través de su representante legal o quien haga sus veces, que en el término de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, si no lo hubiere hecho autorice y realice la afiliación al Sistema de Seguridad Social en Salud (Sisben) de la señora Margarita Pérez Durango, y se otorgue la atención medica que requiera para el tratamiento de la enfermedad que padece.
- Por Secretaría General, LÍBRENSE las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
