PRIMERO. CONFIRMAR las sentencias de 25 de octubre de 2002, del Juzgado 31 Civil del Circuito de Bogota, y la de segunda instancia proferida por la Sala Civil del Tribunal Superior del Distrito Judicial de Bogota D.C., el 24 de enero de 2003, pero por las razones expuestas en el presente fallo.
SEGUNDO. Dejar sin efecto juridico la providencia proferida por la Sala Civil del Tribunal de Bogota el 10 de febrero de 2003, en la cual el ad-quem resolvio: "ADICIONAR la sentencia de fecha 24 de enero de 2003, para denegar el amparo solicitado como mecanismo transitorio".
TERCERO. Por Secretaria, LIBRESE la comunicacion prevista por el articulo 36 del decreto 2591 de 1991.
