- Primero. REVOCAR el fallo proferido el 15 de septiembre de 1992 por el Juzgado
- Quinto. Penal Municipal de Ibagué, por medio del cual se denegó la tutela promovida por MARIA MIRLLAN IRIS SARMIENTO HERNANDEZ en representación de su hijo, el menor AUGUSTO GALAXIO EDISON SARMIENTO.
- Segundo. CONCEDER la tutela solicitada, ordenando al Instituto Tolimense de Educación Especial que levante de inmediato la medida adoptada en contra del menor, procediendo a reintegrarlo a los cursos que venía recibiendo.
- Tercero. Ordenar al Instituto Tolimense de Educación Especial disponer la práctica de exámenes médicos al menor AUGUSTO GALAXIO EDISON SARMIENTO, a fin de establecer la clase de alimentación que debe recibir.
- Cuarto. Líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
