- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E:
- PRIMERO. Revocar la providencia proferida por el Tribunal Superior del Distrito Judicial de Santafé de Bogotá - Sala Disciplinaria, el día 20 de mayo de 1992, mediante la cual se decidió sobre la acción de tutela instaurada por ALVARO CAMACHO FONSECA.
- SEGUNDO. Comuníquese al Tribunal Superior del Distrito Judicial de Santafé de Bogotá - Sala Disciplinaria el contenido de esta providencia, según lo dispone el artículo 36 del Decreto 2591 de 1991. Una vez notificada, adecúe su fallo a lo dispuesto en ella y, en especial, para que ordene al Juez Once Penal Municipal de Santafé de Bogotá dictar resolución inhibitoria o resolución de apertura de instrucción según el caso, dentro del expediente aludido en la demanda de tutela instaurada por ALVARO CAMACHO FONSECA, en un término que no podrá exceder los diez (10) días hábiles siguientes a la notificación de esta providencia.
- TERCERO. Remitir copias del expediente y del presente fallo a la Procuraduria Delegada para la Vigilancia Judicial y al Consejo Superior de la Judicatura -Sala Disciplinaria, para lo de su competencia.
