Primero. CONFIRMAR la sentencia proferida por la Sala Penal del Tribunal Superior de Bogotá de 18 de marzo de 2002, únicamente por existir un hecho superado.
Segundo. ADVERTIR a Sanitas E.P.S. que en tanto ya realizó la operación que requería el menor Eduardo Andrés Pardo Espitia, puede repetir lo pagado en cumplimiento del fallo de primera instancia, en contra del Fondo de Solidaridad y Garantía del Sistema de Seguridad Social Integral en Salud, subcuenta de enfermedades catastróficas y abstenerse de hacer el recobro a los padres del menor.
Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
