Primero. REVOCAR la sentencia pronunciada dentro del presente asunto por el Juzgado
Décimo. Civil del Circuito de Santa Fe de Bogotá.
Segundo. CONCEDER la tutela de los derechos a la vida, la integridad personal, la salud y la seguridad social de Karen Tatiana Rodríguez Cuenca.
Segundo. ORDENAR a la Empresa Promotora de Salud del Seguro Social, Seccional Cundinamarca, que si previo dictamen de los especialistas, se llegare a la conclusión de la necesidad de un implante coclear, se proceda a dicha intervención en el término de un mes contado a partir de la fecha del diagnóstico, sin que pueda oponer la entidad la existencia de normas legales que excluyan el tratamiento del Plan Obligatorio de Salud.
Tercero. En caso de procederse a la cirugía de implante coclear, la E.P.S. del Seguro Social, podrá repetir lo pagado en cumplimiento de la orden contenida en el numeral tercero, en contra del Fondo de Solidaridad y Garantía del Sistema de Seguridad Social Integral en Salud, subcuenta de enfermedades catastróficas.
Cuarto. Por Secretaria, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
