- Primero. CONFIRMAR la sentencia proferida por la Sala Laboral del Tribunal Superior de Bogotá el 10 de julio de 2002, por cuanto en el presente caso, se ha configurado un hecho superado.
- Segundo. ADVERTIR a Sanitas E.P.S. que en tanto ya realizó el procedimiento quirúrgico y suministró el audífono que requería la señora Luz Francy Rubiano González, puede repetir lo pagado, en contra del Fondo de Solidaridad y Garantía del Sistema de Seguridad Social Integral en Salud, subcuenta de enfermedades catastróficas y abstenerse de hacer el recobro a la demandante.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
