- Primero. REVOCAR la sentencia proferida dentro de la acción de tutela de la referencia, por el Juzgado Setenta y Tres Penal del Circuito de Bogotá, el veintitrés (23) de abril de mil novecientos noventa y seis (1996).
- Segundo. CONCEDER la tutela al derecho fundamental de petición, y en consecuencia se ordena al Instituto de Seguros Sociales, que si todavía no lo ha hecho, proceda a poner en conocimiento de la señora Rosa Quintero de Cruz, la respuesta adoptada en relación con su petición de reconocimiento y pago de pensión de vejez, dentro del improrrogable término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta sentencia.
- Tercero. COMUNICAR, por Secretaría General de la Corte Constitucional, el contenido de la sentencia al Juzgado Setenta y Tres Penal del Circuito de Santafé de Bogotá, para que sean notificadas las partes, de conformidad con lo dispuesto en el artículo 36 de decreto 2591 de 1991.
