  1. en nombre del pueblo y por mandato de la Constitucion Politica,
  2. R E S U E L V E :
  3. Primero. REVOCASE el numeral
  4. primero. del fallo de tutela calendado 11 de julio de 1994, proferido por la Juez Once Laboral del Circuito de esta ciudad, conforme a lo expuesto en la parte motiva de esta providencia.
  5. Segundo. En su lugar, CONCEDESE la accion de tutela por vulneracion del derecho constitucional fundamental de peticion y, en consecuencia, se ordena a la Caja Nacional de Prevision Social de esta ciudad, que dentro del termino de cuarenta y ocho (48) horas, contadas a partir de la notificacion de esta sentencia, resuelva el recurso de apelacion presentado desde el 3 de febrero de 1994, por el senor Rito Antonio Tapias Moreno, si para la fecha de esta decision no lo ha hecho.
  6. Tercero. COMUNIQUESE el contenido de esta decision al Juez Once Laboral del Circuito de esta ciudad, el cual notificara la sentencia de esta Corte a las partes y adoptara las decisiones necesarias para adecuar su fallo a lo dispuesto por esta, de conformidad con el articulo 36 del decreto 2591 de 1991.
