Para la sala, en primer lugar es innegable que el derecho a la salud de un menor es fundamental y tiene prioridad sobre los derechos de los demás y no puede quedar desprotegido bajo ninguna circunstancia, se cita la sentencia T 933 de 2001, se procura la protección de la menor solicitando su afiliación al SISBEN y como ya se encuentra afiliada, no se concede el amparo.
