- Primero. REVOCAR la sentencia proferida por el Juzgado Dieciocho de Familia, el día 16 de julio de mil novecientos noventa y ocho, al decidir la acción de tutela promovida por Nancy Stella Zapata Hernández contra Jairo Iza Herrán.
- Segundo. CONCEDER la tutela solicitada por la señora Nancy Stella Zapata Hernández.
- Tercero. ORDENAR al Defensor del Pueblo, la orientación e instrucción a la actora, en el ejercicio de sus derechos ante las autoridades competentes, en orden a hacer efectiva la responsabilidad, civil y/o penal en que pudo haber incurrido el demandado, conforme a lo dispuesto en esta providencia.
- Cuarto. Por Secretaría líbrense las comunicaciones pertinentes, para los efectos señalados por el artículo 36 del Decreto 2591 de 1991.
