- Primero. Se REVOCA la sentencia de segunda instancia proferida por la Sección Segunda del Consejo de Estado el 9 de mayo de 1996 en cuanto rechazó por improcedente la tutela, y, en su lugar se CONFIRMA la de primera instancia proferida por el Tribunal Contencioso Administrativo de la Guajira el 29 de marzo de 1996 que denegó la tutela, y, por lo tanto, NO SE CONCEDE la tutela instaurada por el Instituto de los Seguros Sociales contra la sentencia del Tribunal Superior de Riohacha, Sala Laboral, de fecha 9 de febrero de 1996, pero por las razones expuestas en el presente fallo.
- Segundo. Para los efectos del artículo 36 del decreto 2591 de 1991, el Juzgado de origen hará las notificaciones y tomará las medidas adecuadas.
