- Primero. REVOCAR en todas sus partes la sentencia proferida en segunda instancia por la Sala Civil del Tribunal Superior del Distrito Judicial de Bucaramanga el 13 de mayo de 1996, en el caso de la acción de tutela instaurada por MILENA TINOCO TOLOSA.
- Segundo. SE CONFIRMA el fallo de primera instancia, proferido el 21 de marzo de 1996 por el Juzgado Civil del Circuito Especializado Provisional de Bucaramanga.
- Tercero. El Juzgado de primera instancia verificará el cabal cumplimiento de lo ordenado, que estará a cargo del Director de Reclutamiento del Ejército y del Comandante del Distrito Militar No. 32 de Bucaramanga, bajo el apremio de las sanciones previstas en el Decreto 2591 de 1991.
