- PRIMERO. REVOCAR la Sentencia proferida por el Tribunal Administrativo de Cundinamarca -Seccion Segunda, Subseccion B-, por las razones expuestas en esta sentencia.
- SEGUNDO. CONCEDER en consecuencia la tutela a Oliva Melo Rodriguez, en representacion de Jose de Jesus Martinez, por los motivos expuestos en este fallo, y en consecuencia, ORDENAR a la Caja Nacional de Prevision, que en el termino de cuarenta y ocho (48) horas incluya en nomina de pensionados a Jose de Jesus Martinez a fin de que entren a disfrutar efectivamente de su respectiva pension.
- TERCERO. NEGAR la solicitud de tutela en lo relativo a las pretensiones de mayor valor de la pension de jubilacion, controversia esta sobre derechos sustanciales que debe ser resuelta por los jueces competentes.
