- PRIMERO. CONFIRMAR la sentencia de fecha 28 de febrero de 1994 del Juzgado Veintidós Penal del Circuito de Santafé de Bogotá, por medio de la cual se confirmó el fallo proferido por el Juzgado Sesenta y Cuatro Penal Municipal de la misma ciudad, que denegó la tutela interpuesta por Rafael Garzón Ballesteros contra la Junta Directiva del Condominio Campestre "El Peñón".
- SEGUNDO. Comunicar la presente decisión al Juzgado Sesenta y Cuatro Penal Municipal de Santafé de Bogotá, con el fin de que proceda a dar cumplimiento a lo dispuesto por el artículo 36 del decreto 2591 de 1991.
