- Primero. REVÓCASE la sentencia proferida el veintisiete de abril de 1998 por el Juzgado Cincuenta y cuatro Penal del Circuito de Santa Fe de Bogotá.
- Segundo. CONCÉDESE la tutela impetrada por HERNANDO FALLA GUTÍERREZ.En consecuencia, ORDÉNASE a la Caja Nacional de Previsión CAJANAL -Subdirección de Prestaciones Económicas- que, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, resuelva de fondo, concreta y completamente, sobre la solicitud elevada, el 4 de febrero de 1998, por el actor.
- Tercero. La Procuraduría General de la Nación investigará la conducta disciplinaria de los servidores públicos de CAJANAL que hubieren dado lugar a la violación del derecho que se protege. En consecuencia, remítasele copia de este fallo.
- Cuarto. DÉSE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
