Primero. REVOCAR la sentencia del Juzgado 47 Penal del Circuito de Santafé de Bogotá D.C., dictada en segunda instancia el 22 de febrero de 1999.
Segundo. INAPLICAR el numeral 7º del artículo 14 del Decreto 1485 de 1994, según lo expuesto en la parte motiva de esta providencia.
Tercero. TUTELAR los derechos constitucionales fundamentales a la vida y a la igualdad de Juan Nepomuceno Riaño Muñoz y ordenar a Salud Total E.P.S. que, en el término de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, reanude el pago del valor de las incapacidades que le corresponden a partir del mes de mayo de 1999, inclusive, y le restablezca todos los servicios inherentes al plan obligatorio de salud.
Cuarto. Líbrese por la Secretaría General de esta Corporación, la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
