- Primero. REVOCASE el fallo de segunda instancia, proferido por la Sala de Casación Laboral de la Corte Suprema de Justicia, que negó la tutela impetrada, y en su lugar CONFIRMASE el dictado por el Tribunal Superior del Distrito Judicial de Manizales.
- Segundo. No obstante, ADICIONASE dicha sentencia en el sentido de que la compañía demandada podrá solicitar a la Superintendencia Nacional de Salud, después de efectuada la operación al accionante, indicar el número de semanas que, según las normas aplicables, hacía falta cotizar a la afiliada, en los términos del artículo 164 de la Ley 100 de 1993.
- Tercero. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991
