- Primero. REVOCAR la sentencia proferida por el Juzgado
- Segundo. Promiscuo Municipal de Villa del Rosario y, en su lugar, CONCEDER la tutela instaurada por Mariano Jose Pena Mendez, en contra de la rectora del Colegio General Santander, Martha Ligia Gomez Pachon, por vulneracion de su derecho a la educacion.
- Segundo. ORDENAR a la rectora del Colegio General Santander que, dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de esta providencia, presente a consideracion del Juzgado
- Segundo. Promiscuo Municipal de Villa del Rosario, tantas propuestas para remediar, durante el presenta ano escolar, el dano injustamente ocasionado a Mariano Jose Pena Mendez, cuantas sean legalmente permitidas y no impongan al citado estudiante cargas injustificadas.
- Si no hay forma de restablecer, durante 1996, la igualdad del ciudadano Pena Mendez frente a la prestacion del servicio publico de la educacion, o si ninguna de las formulas propuestas es aceptable para el, sera admitido como estudiante regular del colegio General Santander de Villa del Rosario el proximo ano.
- Tercero. ADVERTIR a la rectora del colegio General Santander de Villa del Rosario, que en el futuro debe abstenerse de actuaciones como la que origino el presente proceso, so pena de las sanciones contempladas en el Decreto 2591 de 1991 para el desacato.
- Cuarto. COMUNICAR esta providencia al Juzgado
- Segundo. Promiscuo Municipal de Villa del Rosario (Norte de Santander), para los fines previstos en el articulo 36 del Decreto 2591 de 1991.
