- PRIMERO. Revocar las sentencias del Juzgado Promiscuo Municipal de Galan y del Juzgado Promiscuo del Circuito de Zapatoca, proferidas en la tutela de la referencia y en las cuales se denego la tutela impetrada por el solicitante.
- SEGUNDO. En su lugar se concede la tutela en el sentido de ordenar al Hospital Integrado de Galan: 1) que en el termino de 15 dias se diagnostique la real incapacidad de Alirio Sarmiento Barrera y en el evento que el paciente exija un grupo de examinadores diferente, el hospital lo remitira a otra institucion de las que integran el servicio hospitalario de Santander. 2) En el caso de que el brazo y la mano izquierda del trabajador agrario admitieran total o parcial recuperacion se proporcionara directamente o mediante colaboracion institucional, dentro de lo posible, el tratamiento medico y hospitalario inmediato y adecuado.
- TERCERO. Comuniquese al solicitante, al Director del Hospital de Galan, al Juez Promiscuo y al Personero de dicho municipio, al Defensor del Pueblo, al Ministerio de Salud y a la Superintendencia Nacional de Salud.
