- Primero. REVOCASE el fallo proferido en este asunto por el Tribunal Administrativo de Boyacá el 3 de abril de 1997.
- Segundo. CONCEDESE la tutela impetrada por MARIA LUISA JAIME DE GOMEZ. La Caja Nacional de Previsión -Subdirección de Prestaciones Económicas- deberá resolver de fondo e íntegramente sobre la solicitud de Pensión Gracia presentada por la accionante, en un término que no podrá exceder las cuarenta y ocho (48) horas contadas a partir de la notificación del presente fallo.
- Tercero. La Procuraduría General de la Nación investigará la conducta disciplinaria de los servidores públicos que hayan ocasionado la mora en resolver sobre la petición presentada. Se le remitirá copia de este fallo y del expediente.
- Cuarto. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
