- PRIMERO. Revocar las sentencias de fecha febrero 17 y marzo 30 de 1993, proferidas por los Juzgados 1o. Civil Municipal de Sincelejo y Promiscuo del Circuito de Sincé, mediante las cuales se negó la tutela del derecho invocado por el demandante.
- SEGUNDO. Conceder la tutela de los derechos fundamentales al debido proceso y libertad, vulnerado aquel y amenazado este por la Juez 3o. Penal Municipal de Sincelejo, al imponer al peticionario la sanción de cinco días de arresto, mediante resoluciones 114 y 115 de enero 8 y 29 de 1993.
- TERCERO. Comunicar la presente decisión al Juzgado 1o. Civil Municipal de Sincelejo para que se notifique a las partes, y adopte las medidas necesarias a efecto de adecuar su fallo a lo dispuesto por esta Corporación, según los términos del artículo 36 del decreto 2591 de 1991.
