Primero. REVOCAR el fallo proferido en enero treinta (30) de dos mil tres (2003), por el Juzgado Promiscuo Municipal de San Benito de Abad - Sucre, dentro de la accion de tutela instaurada por la senora Ana Elvira Franco Rodriguez por medio de apoderado contra la Alcaldia Municipal de San Benito de Abad - Sucre y en su lugar, CONCEDE la proteccion del derecho al debido proceso, por las razones expuestas en la parte motiva de esta sentencia.
Segundo. ORDENAR al Alcalde Municipal de San Benito de Abad o quien haga sus veces, que proceda en el termino de cuarenta y ocho (48) horas, contadas a partir de la notificacion del presente fallo, sino se hubiere hecho, a dar cumplimiento a la sentencia proferida en agosto veintidos (22) de dos mil uno (2001) por el Tribunal Contencioso Administrativo de Sucre, en la que se ordeno "reintegro de la senora Ana Franco Rodriguez, al cargo que desempenaba o a otro de igual o superior categoria, por parte del Municipio demandado".
El Juzgado Promiscuo Municipal de San Benito de Abad, como juez de instancia en la accion de tutela de la referencia, velara por el cumplimiento inmediato de la orden que aqui se imparte.
Tercero. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
