- Primero. REVOCAR el fallo proferido por el Tribunal Superior del Distrito Judicial de Bogotá, Sala de Decisión Penal, el 14 de junio de 2000, al resolver la acción de tutela incoada por José María Barrero Alvarez , en su condición de Presidente Nacional del Sindicato de Trabajadores de Gaseosas, Refrescos y Alimentos relacionados con la industria SINTIGAL, contra la empresa "Panamco Indega S.A." y, en consecuencia, proteger los derechos al debido proceso y de acceso a la administración de justicia de dicha organización sindical.
- Segundo. ORDENAR a la empresa "Panamco Indega S.A." dar inmediato y estricto cumplimiento a la sentencia del Tribunal Superior de Bogotá, Sala Laboral, proferida el 18 de mayo de 1999 y mediante la cual se decidió el recurso de homologación interpuesto contra el Laudo Arbitral del 2 de diciembre de 1998.
- Tercero. El incumplimiento de lo aquí dispuesto acarreará la sanción prevista en el artículo 52 del Decreto 2591 de 1991.
- Cuarto. Por Secretaría LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
