- Primero. REVOCAR la sentencia proferida por el Juzgado
- Tercero. Civil Municipal de Girardot el 14 de diciembre de 1999 y, en su lugar, CONCEDER la tutela del derecho fundamental de asociación interpuesta por el doctor Miguel Antonio Medina Heredia. En consecuencia se ordena al representante legal y a los demás directivos de la Empresa Social del Estado Hospital San Rafael de Girardot, inaplicar por ser contraria a la Constitución, la determinación de la Junta Directiva en el sentido de constreñir al demandante a asociarse a una Cooperativa de Trabajo Asociado, para poder seguir prestando sus servicios en ese Hospital.
- Segundo. PREVENIR al representante legal y a los demás directivos de la Empresa Social del Estado Hospital San Rafael de Girardot, para que cese cualquier clase de condicionamiento en contra del demandante, que le impida ejercer en forma libre y espontánea su derecho fundamental al trabajo.
- Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
