- Primero. CONFIRMAR las sentencias de primera y segunda instancia proferidas en este caso por la Sala Civil del Tribunal Superior de Medellín y la Sala de Casación Civil de la Corte Suprema de Justicia y, en consecuencia, negar la protección solicitada por NICOLAS DE JESÚS. CARVAJAL E. contra la Fiscalía Regional de Orden Público de Medellín, División Primera.
- Segundo. Comuníquese a la Sala Civil del Tribunal Superior de Medellín para que notifique la sentencia a las partes, según lo establecido por el artículo 36 del decreto 2591 de 1991, precisando que si el petente se encuentra aún privado de la libertad, el fallo le deberá ser notificado personalmente.
