- Primero. REVÓCASE la sentencia proferida el Juzgado Once Civil Municipal de Bucaramanga, del veinticinco (25) de junio de 2003, que denegó la acción de tutela instaurada por Gabriel Marciales Rueda contra Colseguros Administradora de Riesgos Profesionales y la EPS Colmena Salud. En su lugar, CONCÉDASE el amparo solicitado, en los términos expresados en la parte motiva de esta providencia.
- Segundo. ORDENASE al representante legal de la EPS Colmena Salud o quien haga sus veces, que en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta providencia, otorgue al actor la atención médica que necesita, mientras la junta calificadora de riesgos profesionales, decide el conflicto presentado con la ARP Colseguros, teniendo a su favor la acción de repetición por los sobrecostos que llegaré a cancelar.
- Tercero. Por Secretaría General, líbrense las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
