- Primero. REVOCAR las sentencias proferidas por el Juzgado Penal Municipal de Cereté de fechas 16 y 28 de diciembre de 1998, y en su lugar CONCEDER la tutela de los derechos al trabajo y a la vida, por violación del mínimo vital, de los accionantes Elsy del Socorro Muñoz Reza, Osvaldo Carvajal Domínguez y Socorro Petro Grondona.
- Segundo. ORDENAR al Director del Hospital San Diego de Cereté que, si todavía no lo ha hecho, proceda, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, a cancelar a los accionantes Elsy del Socorro Muñoz Reza, Osvaldo Carvajal Domínguez y Socorro Petro Grondona, los salarios atrasados, correspondientes al año de 1998, siempre que exista partida presupuestal disponible. Si esta fuere insuficiente, deberá en el mismo término, iniciar las diligencias encaminadas a obtener los recursos para cumplir con lo ordenado.
- Tercero. PREVENIR al Director del Hospital San Diego de Cereté (Córdoba) para que evite volver a incurrir en las omisiones ilegítimas que originaron el presente proceso, so pena de las sanciones legalmente correspondientes.
- Cuarto. LÍBRENSE por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
