- Primero. CONFIRMAR la sentencia de la H. Corte Suprema de Justicia, Sala de Casación Penal, de fecha treinta (30) de enero de mil novecientos noventa y seis (1996), que revocó la sentencia del Tribunal Superior del Distrito Judicial de Santafé de Bogotá, Sala Penal, del veintidós (22) de noviembre de mil novecientos noventa y cinco (1995).
- Segundo. COMUNICAR este fallo al Tribunal Superior del Distrito Judicial de Santafé de Bogotá, Sala Penal, para los efectos previstos en el artículo 36 del decreto 2591 de 1991.
