- Primero. REVOCAR el fallo proferido el diecisiete (17) de enero de dos mil dos (2002), por el Consejo Superior de la Judicatura Sala Jurisdiccional Disciplinaria, dentro de la accion de tutela instaurada por el senor Jaime Sarmiento Suarez contra Cajanal Seccional Bogota y en su lugar, CONCEDE por las razones expuestas en la parte motiva de este fallo.
- Segundo. ORDENAR a Cajanal Seccional Bogota, proceda en el termino de cuarenta y ocho (48) horas, contadas a partir de la notificacion de la presente decision, sino se hubiere hecho, a proferir acto administrativo que resuelva de fondo el recurso de apelacion interpuesto contra la resolucion No. 3932 del 23 de febrero de 2001, por medio de la cual, se concedio pension de vejez al actor.
- Tercero. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
