- Primero. REVOCASE la sentencia dictada por la Juez Doce Penal del Circuito de Santafé de Bogotá, el veinticuatro (24) de febrero de mil novecientos noventa y cuatro (1994), y, en su lugar, DENIEGASE la tutela demandada por el ciudadano GERARDO ANTONIO BERMUDEZ SANCHEZ, o FRANCISCO GALAN.
- Segundo. CONFIRMASE la sentencia proferida por el Tribunal Superior del Distrito Judicial de Santafé de Bogotá, el veintiocho (28) de febrero de mil novecientos noventa y cuatro (1994), sentencia que rechazó por improcedente la tutela solicitada por el ciudadano GERARDO ANTONIO BERMUDEZ SANCHEZ, o FRANCISCO GALAN, por los motivos expuestos en esta sentencia.
- Tercero. Quedan sin efectos todos los actos cumplidos en ejecución de la sentencia que se revoca.
- Cuarto. REMITASE al Consejo Seccional de la Judicatura de Cundinamarca, Sala Disciplinaria, copia de la segunda instancia del proceso tramitado en los juzgados Setenta y seis Penal Municipal y Doce Penal del Circuito, así como de esta sentencia, para que se investigue la conducta de la Juez Doce Penal del Circuito de Santafé de Bogotá, al dictar el auto de marzo catorce (14) de mil novecientos noventa y cuatro (1994), de conformidad con lo expuesto en la parte motiva de esta sentencia.
- Quinto. COMUNIQUESE esta sentencia al Juzgado Setenta y seis Penal Municipal y al Tribunal Superior del Distrito Judicial de Santafé de Bogotá, para que sea notificada a las partes, de conformidad con el artículo 36 del decreto 2591 de 1991.
