- Primero. CONFIRMAR la sentencia proferida por la Corte Suprema de Justicia, Sala Penal, el diez (10) de Octubre de 1996, que a su vez confirmo la providencia dictada por el Tribunal Superior del Distrito Judicial de Santa Fe de Bogota, el veintiuno (21) de agosto de 1996, que denego la tutela formulada por el municipio de Puerto Boyaca, Boyaca, contra las sentencias dictadas por el Tribunal Contencioso Administrativo de Boyaca, Sala Plena, y por el Consejo de Estado, Sala de lo Contencioso Administrativo, Seccion Cuarta, por las razones expuestas en la parte motiva de esta providencia.
